The petitioner seeks bail in connection with Mirganj P.S. Case No. 320 of 2017 registered under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act-2016.

35 lts. of country made liquor is said to have been recovered from the motorcycle of the petitioner and petitioner was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. As a matter of fact, seeing gathering, the petitioner had rushed there out of curiosity but as the police chased the persons, he tried to escape, but was apprehended by

Patna High Court Cr.Misc. No.7934 of 2018(2) dt.15-02-2018 2/2 the police and roped in the case with altogether wrong story and planting recovery of alleged liquor from his possession. The petitioner has no criminal antecedent. He has been languishing in custody since 21.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge-2nd-cum-Special Judge, Gopalganj in connection with Mirganj P.S. Case No. 320 of 2017. (Prakash Chandra Jaiswal, J) rohit/- U T
