JUSTICE SANDEEP KUMAR ORAL ORDER 05-03-2024 At the very outset, learned counsel for the petitioners has submitted that due to mistake, in paragraph No. 3 of the petition, the criminal antecedent of the petitioners has been given to be clean whereas the petitioner No. 1 is accused in Kishanpur P.S. Case No. 17 of 2019 registered under Sections 379 of the Indian Penal Code and other Sections.

2. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

3. The petitioners seek bail in connection with Kishunpur P.S. Case No. 241/2021 registered for the offence punishable under Sections 147/148/149/341/323/324/ 326/307/

Patna High Court CR. MISC. No.81160 of 2023(3) dt.05-03-2024 2/2 379/ 504/506 of the Indian Penal Code and Section 25(1-b)a, 26/37/27 Arms Act. Subsequently, Section 302 of the Indian Penal Code has also been added.

4. The petitioner No. 1 (Rama Yadav) is said to be the assailant of the deceased. He is in jail since 06.06.2023.

5. Considering the fact that petitioner No. 1 Rama Yadav is the assailant of the deceased, his prayer for bail is dismissed.

6. So far as petitioner No. 2 Anil Kumar is concerned, there is general and omnibus allegations against him. He is in Jail since 10.3.2023.

7. Considering the period of custody and also the general and omnibus allegations levelled against the petitioner No. 2, let the petitioner No. 2 (Anil Kumar) above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Kishanpur P.S. Case No. 241 of 2021.
