The petitioner apprehends his arrest in connection with Naubatpur P.S. Case No. 653 of 2015 for the offence registered under sections 302 and 34 of the Indian Penal Code lodged on 06.11.2015 by the informant, Niraj Kumar. The prosecution case, in brief, is that on 06.11.2015, at 21:00 Hrs., the informant reported before the police that his father was running clinic since last eight years in the house of Shivendra Thakur on rent. One case was there between the landlord Shivendra Thakur and the tenant -informant's father for the rent. Shivendra Thakur had threatened his father of dire consequences.
On 06.11.2015, at around 07:30 Hrs., while the informant and his father namely, Awdhesh Narayan Kushwaha were in the house, in the meantime, Shivendra Thakur, Ram
Patna High Court CR. MISC. No.3725 of 2023(2) dt.22-05-2023 2/2 Balak Thakur, Subodh Thakur, Rajnish Thakur and three unknown persons armed variously attacked his father. The accused injured him brutally by dagger and later left the place. He further succumbed to the injuries. Hence, the FIR. This is the second attempt of the petitioner. The first being Cr. Misc. No. 5829 of 2016 dismissed on 23.02.2016 by a bench of this Court (Hon'ble Mr. Justice Rakesh Kumar, as his Lordship then was).
The matter is of 2015 and for eight years the petitioner has evaded arrest and after dismissal of his anticipatory bail in 2016 i.e. seven years, another anticipatory bail is filed, the same is accordingly dismissed. It is ironical that a named accused is roaming free for last eight years without being apprehended. What message the District Police head is giving to the society, it is for him/her to think.
