====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 17-05-2023 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bairiya P.S. Case No. 245 of 2022, registered under Sections 341, 323, 353, 354, 504 and 506/34 of the Indian Penal Code.

As per allegation made in the F.I.R. that petitioner assaulted the informant headmaster of the school Rajkiya Utkarmit Vidyalaya, Bhatwaliya, West Champaran. Learned counsel appearing on behalf of the petitioner submitted that petitioner was prevented by the informant from getting Covid-19 vaccine. The petitioner has not assaulted the headmaster.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

No.74521 of 2022(2) dt.17-05-2023 2/2 Considering the nature of allegation made in the F.I.R. as well as the fact that petitioner had gone for vaccination during Covid-19 pandemic, the petitioner, above named is directed to be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-III, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 245 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
