JUSTICE ARUN KUMAR ORAL ORDER 08-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bakhtiyarpur PS Case No. 376 of 2017 registered under Sections 323, 324 and 307/34 of the IPC.

Learned Counsel for the petitioner submits that the informant is not the eye witness and the injured statement has not been recorded; three persons are named accused in this case and only two injuries were found on the person of the informant's son, one is simple and another is said to be grievous but the petitioner has no criminal antecedent and is in custody since 28.10.2017. Having considered the said facts and circumstances, the petitioner, namely, Mithilesh Mukhiya is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Saharsa in connection with Bakhtiyarpur PS Case No. 376 of 2017.
