2. The petitioners have prayed for regular bail in a
Patna High Court CR. MISC. No.79150 of 2024(3) dt.24-02-2025 2/3 case registered for the offence punishable under sections 61, 103 (1), 238, 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The case of the prosecution is that one Aniket Kumar who aged about 12 years was sleeping at his house. None of the family members was there. As Aniket was alone, assused, namely, Ravi Ram and Vinod Ram took him and killed him by pressing his neck. It is further alleged that on the advise of Jahuri Ram and Pradip Ram rope was tied in the neck to show that it was a suicide. It is further alleged that Jahuri Ram was having a boy in his lap and was going to through the body in the field. Meanwhile, Hira Devi saw him and raised alarm. On this accused persons left the corpse and fled away from the place of occurrence. Hence, the present FIR.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in connection with the present case. Moreover, the petitioners are languishing in judicial custody since 03.08.2024 having no criminal antecedent.
5. Learned counsel for the Informant from perusal of the case diary submits that the witness, namely, Hira Devi has supported the case of the prosecution. Further on perusal of the post-mortem report, it also transpires that the death has been

6. Considering the aforesaid facts and circumstances of the case and the submissions put forward by the parties, I am not inclined to extend them privilege of bail for the present which is accordingly rejected.
However, they will be at liberty to renew his prayer for bail after six months if the trial is not concluded. (Ashok Kumar Pandey, J) Jagdish/- U T
