This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 147, 148, 149, 341, 323, 307, 379, 384, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act, registered in connection with Sonpur P.S.Case No. 01 of 2022.

As per allegation, co-accused Prem Kumar Singh @ Pumpum Singh, Samir Singh and the petitioner demanded rupees five lakh as ransom from the informant and threatened him to face dire consequences had their demand remained unfulfilled. The informant complained to the father of coaccused Prem Kumar Singh, but he also drove away the

Patna High Court CR. MISC. No.1167 of 2023(2) dt.27-03-2023 2/3 informant from his shop. In the next morning, the accused persons, named in the FIR, came to the shop of the informant and opened fire which hit the counter and they snatched a cash of Rs.45,000/-.

The learned counsel for the petitioner has submitted that he is innocent and has falsely been implicated in this case. He has submitted further that the allegation of firing is false. None has suffered any kind of injury. The petitioner is a person of clean antecedent and is in custody since 01.11.2022. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection Sonpur P.S.Case No. 01 of 2022. subject to the following conditions:-

1. The petitioner shall cooperate in the disposal of trial and make available as and when required by the court.

2. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for
