JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Haspura P.S. Case No. 62 of 2019 registered for the offences punishable under Sections 420, 406, 409 and 34 of the Indian Penal Code.

Petitioner happens to be Panchayat Secretary and as per FIR a cheque of Rs.5 lac was issued in favour of petitioner under Jal Nal Yojna by the Chairman of Ward No.12 but he has purchased cement though there is no provision for that. Submission of learned counsel for the petitioner is that he has already return Rs.5 lac, which will appear from Annexure-2, which is a letter issued by Prakhand Vikash Padadhikari.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.68993 of 2019(2) dt.04-11-2019 2/2 petitioner surrender within a period of three weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Daudnagar (Aurangabad), in connection with Haspura P.S. Case No. 62 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
