Petitioner seeks bail in a case registered for the offences punishable under Sections 8, 20, 21 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985. From the house of the petitioner three hundred grams of Ganja was, allegedly, recovered.
Submission is that the petitioner has got no criminal antecedent. The recovered quantity is small quantity. The petitioner is in custody since 29.11.2017. Investigation is complete now and the petitioner is ready to cooperate with trial. Other coaccused, namely, Ram Lakhan Rai, having similar allegation, has already been allowed bail by this Court vide order dated 15.02.2018 passed in Cr. Misc. No. 8791 of 2018.
Patna High Court Cr.Misc. No.11439 of 2018 (2) dt.28-02-2018 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with N.D.P.S. Case No. 20 of 2017, Reg. No. 23/2017 arising out of Bakhri Police Station Case No. 300 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
