The petitioner seeks bail in connection with Kotwali P.S. Case no. 98 of 2018 registered under Section 30(a) of Bihar Prohibition & Excise Act-2016.

80 lts. of country made liquor is said to have been recovered from the room of Lal Babu who is said to have given it to the petitioner on rent for keeping in it articles of the marriage.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern either with the seized liquor or with the aforesaid room. He had never

Patna High Court Cr.Misc. No.22329 of 2018(2) dt.17-04-2018 2/2 taken the said room from Lal Babu and said Lal Babu has falsely implicated the petitioner in the case to save his skin from the occurrence. He has no criminal antecedent. He has been languishing in custody since 07.03.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Kotwali P.S. Case no. 98 of 2018.
