The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The main allegation is that the present petitioner along with other co-accused persons assaulted the informant and his family members by means of lathi. It is further alleged that at the instance of this petitioner, other co-accused persons fired upon the informant and his son.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The specific allegation of shot fire upon the informant and his son is against other

Patna High Court CR. MISC. No.74562 of 2022(3) dt.15-03-2023 2/2 co-accused namely, Satyendra Singh and Mukeh Yadav. There is no specific overt-act against this petitioner rather general and omnibus allegation of assaulting by means of lathi is leveled against him. It is further submitted that good sense has been prevailed between the parties which is mentioned in Annexure2. The petitioner has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 15.10.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Tier P.S. Case No. 31 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Bhojpur at Ara.
