2. The petitioners are apprehending their arrest in connection with Chapra Mufassil P.S. Case No. 63 of 2025 registered for the offences punishable under Sections 115(2), 74, 76, 109, 303(2), 307, 351, 352 of the Bharatiya Nyaya Sanhita, 2023 and 27 of the Arms Act.

Based upon the complaint case, the prosecution alleges that petitioner no.1, who has been residing in the same house, tried to misbehave and ravished the complainant on various occasions and when this incident has been brought to the knowledge of her mother, she protested for the same, thereupon the other accused persons, including the petitioners
Patna High Court CR. MISC. No.78477 of 2025(2) dt.27-11-2025 2/3 have assaulted the mother of the informant and snatched valuables.
4. Learned Advocate for the petitioners submitted that both the petitioners are uncle of the informant and residing in the same parental house, however, only on account of the fact that just prior to the present case, the wife of petitioner no.1 had instituted an F.I.R. against the informant and her family members, bearing Chapra Mufassil P.S. Case No. 671 of 2024 on 10.11.2024, the present case has been filed in retaliation by making a frivolous allegation. The petitioners are men of fair antecedent and undertake that they will fully cooperate in the proceeding of the court.
5. On the other hand, learned APP for the State vehemently opposes the bail application and submits that the petitioners are facing serious allegation of outraging the modesty and ravishing the informant.

Regard being had to the submissions made on behalf of the parties and considering the submissions, especially the fact that prior to the institution of the present case, an F.I.R. has been instituted by the wife of petitioner no.1, as also the fair antecedent of the petitioners and the close relationship of the parties, let the petitioners, named above, in the event of their

No.78477 of 2025(2) dt.27-11-2025 3/3 arrest or surrender before the court below within four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra in connection with Chapra Mufassil P.S. Case No. 63 of 2025, subject to the condition as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close relative of the petitioners.
