JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-01-2020 This application, for grant of anticipatory bail, arises out of Patepur No. 224/18, disclosing offences under Sections 364/120(B) of the Indian Penal Code and Section 13, 16, 19, 20 of the U.A.P. Act.
Prosecution case is that two persons were abducted and alter on their dead bodies were recovered and informant went there and saw the petitioner at the place of occurrence. Submission of learned counsel for the petitioner is that except that she was seen at the place of occurrence, there is absolutely nothing against her. Further submission is that she has no criminal antecedent and has falsely been implicated in this case.
Learned A.P.P. opposed the prayer of anticipatory bail of the petitioner on the ground that the witnesses have also

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner has to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
This application is, accordingly, dismissed.
