2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 406, 409/34 of the Indian Penal Code.

3. The prosecution case, as per the F.I.R. lodged by the Panchayat Secretary of Shivpur Gram Panchayat, is that irregularities were committed in the implementation of the scheme, namely, Chief Minister's Nal Jal Yojana, in Ward Nos. 3, 4, 7, 8, 9, 11, 13 and 15. The total amount for the execution of the scheme, in question, was sanctioned to the tune of Rs. 14,98,400/-, out of which Rs. 13,00,000/- was transferred to different wards, but the petitioner, who was Mukhiya of the Panchayat at the relevant time, along with others, mis-utilized the funds and defalcated huge amount.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner was Mukhiya of the Panchayat and had no role in execution of the Nal Jal Yojana. She transferred the amount to each ward through cheques and the work in question has already been completed. Similarly situated co-accused persons have already been granted anticipatory bail by this Court vide order dated 24.09.2025 passed in Cr. Misc. No. 67991 of 2025. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation, clean antecedent and the fact that work in question has been completed, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of her arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1, Bhojpur at Ara in connection with Sahpur P. S. Case No. 147 of 2023, subject to condition as laid down under
