Petitioner seeks bail in a case registered for the offences punishable under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Allegation against the petitioner is that about 14 Kilograms of Ganja was recovered from his possession. The petitioner is in custody since 21.09.2016.

This Court had earlier refused prayer for bail on 04.04.2017 in Cr. Misc. No. 54390 of 2016 with direction to expedite the trial and conclude the same preferably within nine months.

Learned counsel for the petitioner submits that the impugned order would reveal that only three prosecution

Patna High Court Cr.Misc. No.16123 of 2018 (2) dt.18-04-2018 2/2 witnesses have been examined up till now.

Considering the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No. 15 of 2016 arising out of Naugachhiya Rail Police Station Case No. 27 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
