This is an application for regular bail in connection with Motihari P. S. Case no. 365 of 2017 registered for the offences punishable under Sections 147, 148, 149, 323, 307, 379, 387, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act and Section 33 of the Indian Forest Act. Allegation against petitioners is that firstly they demanded ransom of Rs. 5,00,000/- from the informant and later on they came to the house of informant, opened fire and demanded ransom.
It is submitted on behalf of the petitioners is that allegation
Patna High Court Cr.Misc. No.1390 of 2018(3) dt.05-02-2018 2/2 made against them is false and fabricated. It is further submitted that ransom was demanded from the mobile phone of son of the informant. Petitioners are in custody since 15.11.2017. It is further submitted that co-accused persons have been granted anticipatory bail by this Hon,ble Court vide Cr. Misc. no. 45606 of 2017.
Learned counsel for the State and informant has vehemently opposed the prayer for bail.
Considering the facts and circumstances of the case, let above named petitioners be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran, in connection with Motihari Muffasil P. S. Case No. 365 of 2017.
