The petitioner seeks bail in a case registered under Sections 147, 148, 149, 295, 341, 323, 307, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act.
Allegation is that the accused persons including the petitioner caught hold of the informant on the way to his house and co-accused Shiv Shankar Kumar pressed his neck by means of leg and took out Rs.4500/- from his pocket. On hulla they left the scene. After a short while they again arrived at the village armed with deadly weapons and tried to disturb communal harmony.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.06.2019. Charge sheet has
Patna High Court CR. MISC. No.68349 of 2019(2) dt.25-10-2019 2/2 been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. General and omnibus allegation has been made. No specific overt act is alleged against the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Sarai P.S. case No.102 of 2019.
