2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 96 and 3(5) of BNS and 8 of POCSO Act.

3 . As per the prosecution case , on 05.02.2025 , all the F.I.R. named accused persons including these petitioners are alleged to have kidnapped the minor daughter of informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged. The victim in her statement recorded under section 183 BNSS

Patna High Court CR. MISC. No.76085 of 2025(2) dt.10-12-2025 2/2 has not supported the prosecution case . Petitioners claim clean antecedent.

5 . Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the statement of the victim recorded under section 183 BNSS , clean antecedent of these petitioners and circumstances of the case , in the event of arrest or surrender within eight weeks from today, let these petitioners, as named above , be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessiob Judge - cum- Special Judge POCSO Act, Supaul in connection with Rajeshwari P.S. case No. 24 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
