The petitioners seek bail in connection with Alamnagar P.S. Case No. 270 of 2017 registered under Sections 323, 341, 353/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act-2016.
55 lts. of country made liquor is said to have been recovered from the motorcycle which was in occupation of the petitioners.
It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from their conscious physical possession. The petitioners have been falsely
Patna High Court Cr.Misc. No.7345 of 2018(2) dt.13-02-2018 2/2 implicated in the case. The petitioners have no criminal antecedent. The petitioners have been languishing in custody since 12.11.2017.
In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Udakishunganj at Madhepura in connection with Alamnagar P.S. Case No. 270 of 2017.
