The petitioner in this case is seeking anticipatory bail in connection with Dhansoi P.S. Case No. 74 of 2019 registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case only on the basis of suspicion. It is further submitted that the implication of the petitioner is due to solemnization of marriage by the brother of the petitioner with the niece of the informant which was not acceptable to him.

Learned APP has not controverted the submission made on behalf of the petitioner.

Considering the facts and circumstances of the case

No. 71125 of 2019(2) dt.18-12-2019 2/3 wherein the submission of learned counsel for the petitioner that his name has been brought in this case on mere suspicion and that it has been done so because the brother of this petitioner has solemnized marriage with the niece of the informant which is not acceptable to him and for that reason the accusation has been made having remain uncontroverted and learned APP submits that the case seems to be based on suspicion, let the petitioner above named in the event of his arrest or surrender within a period of four weeks from today in connection with Dhansoi P.S. Case No. 74 of 2019 be released on bail on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate III, Buxar, subject to the conditions as laid down under Section 438

(2) of the Cr.P.C. i.e.

(i) a condition that the person shall make himself available for interrogation by a police officer as and when required;

(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police
