In this case, the petitioners are seeking anticipatory bail in connection with G.R. No.981 of 2015, arising out of Dehari Nagar (Indrapuri) P.S. Case No.525 of 2015, registered for the offence punishable under Sections 341, 323, 307, 379, 427, 385 and 120(B) of the Indian Penal Code. It appears that the incident has taken place on 20.10.2015. Two F.I.Rs have been lodged i.e. F.I.R. Nos. 485 of
Patna High Court Cr.Misc. No.19112 of 2018(2) dt.06-04-2018 2/3 2015 and 525 of 2015. In F.I.R. No.485 of 2015 the informant, namely, Dharmu Choudhary, is the agnate of present petitioners. Allegation has been made that the son of Shiv Choudhary, who is the informant of this case, has crushed his niece by vehicle and to protect his son as per the petitioners this F.I.R. has been lodged, in which allegation has been made the they have damaged the car of the informant as well as assaulted with the sharp weapons.
Learned counsel for the petitioners submits that it is the informant's son who has crushed the niece of the present petitioners and to put a pressure on the side of the informant F.I.R. no.485 of 2015 has been lodged. Further placed reliance on the order dated 22.12.2017 passed in Criminal Miscellaneous No.62110 of 2017, wherein it has been recorded that some injuries were sustained in finger and allegations are general and omnibus in nature.
Looking to the aforesaid facts and circumstances of the case, let the above-named petitioners, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each
Patna High Court Cr.Misc. No.19112 of 2018(2) dt.06-04-2018 3/3 to the satisfaction of the Sub-Divisional Judicial Magistrate, Dehri (Rohtas), in connection with Dehri Nagar (Indrapuri) P.S. Case No.525 of 2015 (G.R. No.981 of 2015), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
