JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 15-03-2023 Heard learned counsel for the petitioner and learned counsel for the Bihar Staff Selection Commission. Petitioner in this case is seeking the following reliefs:- "(i) For directing the respondents to show/inform the genuine reason with documents to the petitioner for not calling him in the counselling even after qualifying in Main examination.

(ii) For directing the respondents to provide attested copy of answered OMR sheet, marks obtained (in number) of the petitioner as well as answer key for 2nd graduate level Main examination.

(iii) For directing the respondents to provide a suitable post and appointment to the petitioner if he comes in the perimeter of appointment.

(iv) For directing the respondents to pay the cost of litigation to the petitioner with

Patna High Court CWJC No.521 of 2023(2) dt.15-03-2023 2/3 compensation for mental agony, sorrow, suffering and financial hardships.

(v) For grant of any other order/ orders, relief/ reliefs as your lordships may please deem fit and proper in the interest of substantial and natural justice."

From the facts disclosed in the writ application, it appears that the petitioner had participated in the selection process initiated vide Second Graduate Level Competitive Examination, 2014. He appeared in the preliminary test, qualified in the same, participated in the Main examination and was declared qualified.

As per his own case, the Bihar Staff Selection Commission (hereinafter referred to as the "Commission") advertised for counselling of candidates on 20.03.2018 but the petitioner was not called in the counselling whereupon he represented to the Secretary of the Commission but no reply was received by him.

In Paragraph '13' of the writ application, the petitioner states that he came to know from the notice dated 09.09.2022 published on the website of the Commission that all actions have been completed in all published advertisement and respondents have started process for Third Graduate Level Competitive Examination.

Learned counsel for the Commission has rightly

Patna High Court CWJC No.521 of 2023(2) dt.15-03-2023 3/3 contended that the petitioner has approached this Court after about five years from the date he was not called for counselling and at this stage, when the entire selection process is over and the Commission has initiated process for Third Graduate Level Competitive Examination, this writ application need not be entertained.

This Court finds substance in the submission of the learned counsel for the Commission. The delay on the part of the petitioner in approaching this Court is such that he has made himself disentitled for the reliefs prayed.

This writ application is accordingly dismissed. (Rajeev Ranjan Prasad, J) tusharika/- U
