The present revision application has been preferred against the order dated 13.09.2019 passed by learned Additional District and Sessions Judge - I cum Special Judge, Buxar in Cr. Appeal No. 68 of 2019 whereby and whereunder the appeal filed against the order dated 01.08.2019 passed by the learned Juvenile Justice Board, Buxar in JJB No. 583 of 2019 arising

Patna High Court CR. REV. No.1265 of 2019(4) dt.31-01-2020 2/3 out of Buxar (Muffasil) P.S. Case No. 151 of 2019 has been dismissed and the prayer for bail of the petitioner has been rejected.

Learned counsel for the petitioner submits that the petitioner has been declared to be a juvenile vide order dated 29.07.2019 by the Juvenile Justice Board, Buxar. It is further submitted that in the light of the provisions of Section 12 of the J.J. Act, 2015, the petitioner may be either placed in the custody of fit persons or a Probation Officer or released in favour of his father, who shall produce as and when required. It is further submitted that similarly situated co-accused persons, who was also a juvenile, has since been extended the privilege of bail vide order dated 09.01.2020 passed in Criminal Revision No. 1288 of 2019.

Considering the aforementioned facts and that the petitioner has already been declared to be a juvenile under the provisions of the Act, let the petitioner, namely, Jai Prakash @ Jai Prakash Kumar be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Juvenile Justice Board, Buxar or his successor in connection with JJB No. 583 of 2019 arising out of Buxar (Muffasil) P.S. Case No. 151 of

Patna High Court CR. REV. No.1265 of 2019(4) dt.31-01-2020 3/3 2019 in favour of his father, who shall keep him under his guardianship and produce him as and when required.
