The petitioner seeks bail in connection with Kankarbagh P.S. Case no. 901 of 2017 registered under Sections 272, 273 of Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act-2016 77.250 lts. of foreign liquor is said to have been recovered from Indigo Manza Rij car and petitioner along with others who were sitting in the car apprehended.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his conscious physical possession. The petitioner has been languishing in
Patna High Court Cr.Misc. No.7308 of 2018(2) dt.13-02-2018 2/2 custody since 15.11.2017. Similarly situated co-accused namely, Kamal Kishore has been enlarged on bail by this Court vide order dated 12.02.2018 passed in Cr. Misc. no. 7216 of 2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Kankarbagh P.S. Case no. 901 of 2017.
