JUSTICE SUDHIR SINGH ORAL ORDER 19-11-2019 Heard learned counsel for the petitioners, learned counsel for the informant and learned counsel for the State. The petitioners seek bail in a case for the offence registered under Sections 302/34, 120(B) of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that the petitioners made conspiracy in the murder of the husband of the informant due to land dispute.

It has been submitted by learned counsel for the petitioners that the petitioners are languishing in custody since 03.09.2019. The petitioners have got no criminal antecedent. Charge sheet has been submitted in the present case. The

There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners are ladies. There is no eye witness to the alleged occurrence. The name of the petitioners has come in the present case only on basis of suspicion. Except for suspicion, neither there is substantive evidence to suggest the implication of the petitioners in the present case nor there is circumstantial evidence to suggest the participation of the petitioners in the present case. On behalf of the State and the informant, it is submitted that the petitioners are named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Dalsinghsarai, Samastipur, in connection with Ujiyarpur P.S. Case No. 195 of 2019.
