JUSTICE HARISH KUMAR ORAL ORDER 26-11-2025 At the outset, learned Advocate for the petitioners submitted that during the pendency of the present application, petitioner no.1, namely, Rabokhatoon @ Rabo Khatoon @ Bibi Rehana Khatoon, has been arrested and, as such, she does not want to press the present application on behalf of petitioner no.1.

3. The petitioner no.2, namely, Julekha Khatoon @ Bibi Julekha Khatoon, is apprehending her arrest in connection with Laukaha P.S. Case No. 39 of 2025 registered for the offences punishable under Sections 191(2), 191(3), 126(2), 127(2), 115(2), 121(2), 132, 109, 303(2), 324(4) and 352

4. During protest over the death of a person, violent mob of the villagers excited by some individuals, attacked the police personnel and vandalized the police vehicles. A petrol pump is set on fire by the mob. This incidence led to institution of the F.I.R. against 57 named accused persons and 200 to 250 unknown persons.
5. Learned Advocate for the petitioner contended that no specific allegation of any overt act is attributed against the petitioner, besides the petitioner is a female, having fair antecedent. Other co-accused persons, facing identical allegation, have been allowed the privilege of anticipatory bail by the learned coordinate Benches of this Court in Cr. Misc. No. 48178 of 2025 and Cr. Misc. No. 55643 of 2025 vide orders dated 08.08.2025 and 11.08.2025 respectively.
6. On the other hand, learned APP for the State vehemently opposes the bail application.
7. Having considered the submissions advanced by the learned Advocate for the respective parties and taking note of the omnibus nature of allegation, besides the case of the petitioner is based on parity, let the petitioner no.2, namely, Julekha Khatoon @ Bibi Julekha Khatoon, in the event of

No.74920 of 2025(2) dt.26-11-2025 3/3 her arrest or surrender before the court below within four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.5,000/- (Rupees five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Supaul in connection with Laukaha P.S. Case No. 39 of 2025, subject to the condition as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close relative of the petitioner.
