The petitioner seeks bail in Special Case No. 7269 of 2017 arising out of Mokama P.S. Case No. 158 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

71 litres of country made liquor is said to have been recovered from the rickshaw of Chandra Mauli Ram @ Mallu Ram who disclosed the name of the petitioner and other accused in the occurrence.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious

Patna High Court Cr.Misc. No.2719 of 2018 (2) dt.23-01-2018 2/2 physical possession of the petitioner. The petitioner has no concern with the seized liquor. He was not apprehended on the spot. He has been falsely implicated in the case by the said Chandra Mauli Ram @ Mallu Ram due to animosity and grudge with him. He has no criminal antecedent. The petitioner has been languishing in custody since 02.11.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No. 7269 of 2017 arising out of Mokama P.S.
