This is a case registered under Sections 406,420/34 of the Indian Penal Code.

It is submitted by the petitioners' counsel that though the FIR reveals that the petitioners were indulging in performing magic in the courtyard of the victim's house but no seizure has been made. It is also submitted that no case is made out for the offence under Sections 406 or 420 IPC. The petitioners have clean antecedent and they are in custody since 19.11.2017. In the facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named

Patna High Court Cr.Misc. No.12916 of 2018 (3) dt.06-04-2018 2/2 be released on bail on their furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Darbhanga in Bhadurpur P.S. Case No. 485 of 2017 subject to the conditions :

(i) That one of the bailors will be a close relative of the Petitioners who will give an affidavit giving genealogy as to how he is related with the Petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioners.

(ii) That the Petitioners will be well represented on each date and if they fails to do so on two consecutive dates, their bail will be liable to be cancelled.
