The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 332, 353, 504 and 506 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons had caused hindrance in performing official duty of the informant and police officials, assaulted the informant and police officials and also tried to snatch firearm of the police forces.

Learned counsel for the petitioner that submits that the petitioner has been falsely implicated in this case. He further submits that there were several persons assembled at the place of occurrence. He submits that the name of the petitioner and other 24 persons surfaced in this case, on the basis of list

Patna High Court CR. MISC. No.4573 of 2023(2) dt.10-02-2023 2/2 given by local chowkidar who provided list, on pick and choose basis. He submits that, as per the allegation, the injury was found simple in nature. He submits that the petitioner has one criminal antecedent i.e. Kalyanpur P.S. Case No. 309 of 2021, under Section 147, 149, 341, 323, 379, 307, 354, 427, 504 and 506 of the IPC.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Kalyanpur P.S. Case No. 317 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
