JUSTICE ARUN KUMAR ORAL ORDER 18-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Sitamarhi PS Case No. 642 of 2017 registered under Sections 307, 353/34 of the IPC and Sections 25(1-b)a, 26 and 35 of the Arms Act. Submission is that the allegation is of firing but no injury was caused to any person and it is alleged that country made loaded pistol with five live cartridges were recovered from the possession of the petitioner, otherwise he has no criminal antecedent and is in custody since 19.8.2017.

Having considered the said facts and circumstances, the petitioner, namely, Md. Rasul is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Sitamarhi in connection with Sitamarhi PS Case No. 642 of 2017.
