The petitioner, who is in custody, seeks bail in connection with Dehri (Indrapuri) P.S. Case No. 289 of 2017 registered for the offence punishable under Sections 323, 341, 506 of the Indian Penal Code and 6/8 of Protection of Children from sexual offence Act, 2012.

Informant is the father of victim boy who in his written report has stated that his son namely, Aditya aged about 5 years studying in S.K. School. One tutor namely Ranjeet Kumar Tiwary (petitioner) was kept as tutor and it is stated that sexual assault has been made on his son and it has been further stated that on 24.04.2017 his son told that tutor used to commit sodomy upon him and used to give threatening.

Patna High Court Cr.Misc. No.2629 of 2018(3) dt.12-02-2018 2/2 Learned counsel for the petitioner submitted that he is innocent and has been falsely implicated in this case. From perusal of FIR it appears that after one month of the occurrence FIR was lodged and it also appears that when tuition was stopped by the informant then prosecution story as stated in FIR becomes doubtful. It has been further submitted that petitioner visited at the residence of informant to demand dues tuition fee Rs. 4,800/- at the rate of Rs. 800/- per month due to which the informant lodged FIR against the petitioner. It has further been submitted that petitioner has no criminal antecedent and he is in custody since 08.08.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-Cum-Special Judge, Rohtas, Sasaram, in connection with Dehri (Indrapuri) P.S. Case No. 289 of 2017.
