JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 2260C of 2018, disclosing offences under Sections 498A, 307, 379, 494 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Petitioner happens to be the husband of the complainant. There was demand of Magic Car by the petitioner and other family members and for that, assaulting and ousting her from the matrimonial house.
Submission of learned counsel for the petitioner is that the allegation is false and concocted. As a matter of fact, he is still ready to keep her with dignity and care. Further

Having heard both sides, in view of the facts, as stated above, this application is disposed of with a direction to the petitioner to surrender before the learned court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on provisional bail to the satisfaction of the learned court below. During that period, the court below shall issue a notice to the complainant and on her appearance, if she is ready to reside with the petitioner, the provisional bail granted to the petitioner, shall be extended for a further period of six months.
During that period, the learned court below shall watch the conduct of both the parties and considering their conduct, the learned court below shall pass an appropriate order either confirming the bail bonds of the petitioner, otherwise, he is free to pass any other order or orders, which may be deemed fit and proper. It is also made clear that if the complainant in spite of the notice not appeared before the learned court below or she refuse to reside with the petitioner on her appearance, he will confirm the bail bonds of the petitioner.
