The petitioner apprehends his arrest in connection with Khagaul P.S. Case No. 138 of 2019, registered under Sections 363 and 366(A) of the Indian Penal Code. The accusation is that on 25.05.2015, daughter of the informant, Santosh Kumar Singh, left the house but she did not return. His daughter earlier used to talk with Saurabh Kumar @ Monu, son of Ashok Paswan on mobile. The informant raised suspicion about having hand of Saurabh Kumar @ Monu in the kidnapping of his daughter.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case mere
Patna High Court CR. MISC. No.67312 of 2019(2) dt.14-11-2019 2/2 on suspicion, in fact, statement of daughter of the informant was recorded on 23.08.2019, under Section 164 Cr.P.C., in which, she stated that due to ill behaviour of her family members, she left her house and went at Orisa and returned after two months, but she has not disclosed the name of the petitioner in any manner, which would appear from annexure 2 to the application. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned A.C.J.M.-V, Danapur, Patna, in connection with Khagaul P.S. Case No. 138 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
