1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with S.Tr. no. 268 of 2023 arising out of Rail (Kiul) P.S. Case no. 15 of 2023 registered under sections 395 and 412 of the Indian Penal Code.

3. As per the prosecution case, 7-8 unknown accused persons on the point of pistol etc. are said to have committed dacoity in the train.

4. Learned counsel for the petitioner submits that the F.I.R was registered against unknown. The name of the petitioner transpired in course of investigation in the confessional statement of co-accused Tinku Kumar @ Arjun who has been himself enlarged on bail. The petitioner is in

Patna High Court CR. MISC. No.77030 of 2023(3) dt.29-02-2024 2/2 custody since 15.3.2023 and charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R, the material that has transpired in course of investigation, grant of bail to the co-accused Tinku Kumar @ Arjun vide order dated 22.2.2024 passed in Cr. Misc. no. 77247 of 2023 on whose confessional statement the name of the petitioner transpired together with the petitioner having remained in custody for 11 months since 15.3.2023 and charge-sheet having been submitted in the case without putting the petitioner on T.I. parade, the petitioner is directed to be enlarged on bail in connection with S.Tr. no. 268 of 2023 arising out of Rail (Kiul) P.S. Case no. 15 of 2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions JudgeIII, Lakhisarai.
