This application has been filed for regular bail in connection with Excise Case No.646 of 2019 arising out of Mohania P. S. Case No.403 of 2019 passed by the Additional Sessions Judge-4th-cum-Special Judge, Excise, Kaimur at Bhabua.
There is allegation of recovery of more than three thousand litres of liquor from the rice mill of petitioner no.1 and petitioner no.2, who used to carry the same. Petitioner no.2 is the son of petitioner no.1.
Submission of learned counsel for the petitioners is
Patna High Court CR. MISC. No.77513 of 2019(3) dt.09-12-2019 2/2 that rice mill belong to some other person. He was only a night guard watching the liquor. They are falsely implicated and so far other petitioner Rohit Kumar is concerned, he is not named in the F.I.R. They are in custody for three months. Learned A.P.P. opposed the prayer.
In view of the above facts, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (twenty five thousand) each with two sureties of the like amount each to the satisfaction of the 4th Additional Sessions Judge-cum-Special Judge, Excise, Kaimur at Bhabua in connection with Excise Case No.646 of 2019 arising out of Mohania P. S. Case No.403 of 2019.
