Petitioner, already in custody, seeks bail in connection with Hilsa P.S. Case No. 669 of 2017, registered under Sections 448, 341, 323, 307, 504 and 379/34 of the Indian Penal Code.
The allegation against the petitioner is that he made demand of extortion money for taking liquor from the informant and when she denied, the petitioner assaulted and opened fire, causing injury to the informant.
Learned counsel for the petitioner submits that due to some land dispute the petitioner has falsely been implicated in this case and there is no fire arm injury.
Patna High Court Cr.Misc. No.4084 of 2018 (2) dt.01-02-2018 2/2 Learned counsel for the State, on the other hand, submits that the petitioner opened fire and he has also got two criminal antecedents.
Having considered the said facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Hilsa P.S. Case No. 669 of 2017. This is subject to the condition that one of the bailors must be the close family member of the petitioner either of the parents and the petitioner shall be present on each and every date before the court below, as and when required, and in the event of failure on his part to appear before the court below on two consecutive dates, without giving any reasonable explanation, his bail bond shall be liable to be cancelled.
