Petitioner, already in custody, seeks bail in connection with Janta Bazar P.S. Case No.68 of 2017, registered under Sections 302/34 of the Indian Penal Code.

Allegation in brief is that the husband of the informant went to the house of the petitioner to ask for his due money then they started quarreling and Suresh Ram, Manish Kumar, wife of Suresh Ram and this petitioner came armed and assaulted over the head of the husband of the informant causing his death. Learned counsel for the petitioner submits that there is no specific allegation of assault against the petitioner rather the allegation is against others and only one head injury is found on the person of the deceased not attributed to the petitioner and

Patna High Court Cr.Misc. No.15205 of 2018(2) dt.20-03-2018 2/2 others who were said to have assaulted the husband of the informant, namely, Suresh Ram, Rina Devi and Punam Devi have been admitted to bail by a coordinate Bench of this Court by order dated 14.12.2017 passed in Cr. Misc. No.58159 of 2017.

Having considered the aforesaid facts and circumstances, petitioner Surendra Ram is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Saran at Chapra in connection with Janta Bazar P.S. Case No.68 of 2017.
