02. In the present case, the petitioners are apprehending their arrest in connection with Chakia P.S. Case No. 18 of 2024, registered for the offences under Sections 341, 323, 325, 307, 354(B), 385, 386, 447, 504, 506 and 34 of the Indian Penal Code.

03. As per the prosecution case, petitioner and other co-accused persons who were armed with lathi, danda, iron rod and other weapons came to the doors of the informant and starting demanding Rs.1 lakh as extortion. On refusal of the informant, the assailants assaulted the informant and her family

Patna High Court CR. MISC. No.85984 of 2024(2) dt.10-01-2025 2/3 members, causing injuries to them. Further allegation against the petitioner-Rani Devi is that of snatching a gold chain from the informant.

04. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. The entire prosecution story is false and fabricated as it has been filed to pressurize the petitioners to withdraw the Complaint Case No. 92C of 2024 filed by the husband of the petitioner no. 1 and son of the petitioner no. 2, against the informant, her husband and others. There is no specific allegation against the petitioner no. 2 whereas allegation against petitioner no. 1 is of snatching a gold chain, which is completely false and concocted and his super-addition. The allegations in the FIR are absurd and not believable that the whole family along with the children demanded extortion and tried to disrobe the informant and outrage her modesty. Petitioner no. 2 is a person of 72 years old though he is having antecedent of two cases in which he is on bail and the petitioner no. 1 is having clean antecedent.

05. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

06. Having regard to the facts and circumstances and

No.85984 of 2024(2) dt.10-01-2025 3/3 submission made on behalf of the parties and considering the improbable nature of allegation and probability of false accusation, let the petitioners above named, in the event of their arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai/concerned court, in connection with Chakia P.S. Case No. 18 of 2024, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure and other following conditions: (i) One of the bailors will be a close relative of the petitioners.

(ii) The petitioners will remain present on each and every date fixed by the court below, if so required by the learned trial court.
