Heard learned counsel for the petitioner and learned A.P.P. for the State, Shri. Chandra Bhushan Prasad. 2.

The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is aged about 68 years, and the informant alleges that his daughter was married to Jitendra about two years back and after marriage she was tortured, further on 19-12-2023, his daughter-in-law received a call, but the same got disconnected, thereafter she made a return call when Aarti informed that his daughter is ill and is being taken to hospital. It is next alleged that his Samdhin (petitioner) also called and informed that his daughter died due to stomach

The learned counsel appearing on behalf of the petitioner submits that earlier Arti Devi and Tetar Ravidas had approached this court seeking anticipatory bail by filing Cr. Misc No. 55346 of 2024 and the same was allowed by an order dated 2-9-2024. It is next submitted that while granting bail to Arti Devi and Teter Ravidas, the Court had considered the case on merit and in detail. It is next submitted that Arti Devi was granted the privilege of anticipatory bail, who is sister-in-law (Nanad) of the deceased, and the instant petitioner is mother-inlaw of the deceased. It is next submitted that husband of the deceased is in custody.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner and also taking into consideration the order dated 2-9-2024 in Cr. Misc No. 55346 of 2024, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court
