2. The petitioner apprehends her arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
3. As per F.I.R., allegation against the son of the petitioner is that he theft the laptop bag of H.P. and Rs. 3,39,5000/-.
4. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Petitioner has got no criminal antecedent mentioned in Para 3 of the bail application. He further submits that the son of the petitioner was apprehended by the police and he disclosed that he gave some money to the petitioner. No any incriminating
Patna High Court CR. MISC. No.79994 of 2023(2) dt.15-12-2023 2/2 article was recovered from the conscious possession of the petitioner. He further submits that the petitioner is a female aged about 70 years.
5. Learned APP for the State has opposes the prayer for bail.
6. Having regard to the facts and circumstances of the case and also petitioner is female aged about 70 years, let the above named petitioner, be released on bail, in the event of her arrest, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/ successor Court in connection with Danapur P.S. Case No. 907 of 2019, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
