The petitioner seeks bail in connection with Dighal Bank P.S. Case No. 125 of 2017 registered under Sections 30(a) of Bihar Prohibition and Excise Act.

As per prosecution case, 45 lts. of Nepali liquor was being transported by the petitioner and another accused and seeing the police party, the accused persons managed to escape abandoning the motorcycle and the said liquor. Villagers divulged the name of one of the accused as petitioner Md. Guddu. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. Petitioner has no concern with the

The name of the villagers divulging the name of the petitioner as accused has not been disclosed by the police. Though, one case has been lodged against the petitioner which is under bailable Section but the petitioner has been enlarged on bail in the said case. The petitioner has been languishing in custody since 30.11.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge (Excise) Kishanganj in connection with Dighal Bank P.S. Case No. 125 of 2017.
