The petitioner seeks bail in Kuchaikote P.S. Case No.228 of 2019, registered under Sections 406, 409, 420 and 120(B) of the Indian Penal Code and under Sections 30(a), 41(1) and 48 of the Bihar Prohibition and Excise Act. On the basis of the viral news, the informant, Dy.S.P., Gopalganj by the order of the Superintendent of Police, Gopalganj inspected the Kuchaikote P.S. and found shortage of 258.505 litres of liquor and 50 litres of spirit from the actual seized liquor in different cases registered in the police station. Learned counsel for the petitioner submits that during the course of inquiry, Chowkidar Munna Kumar Rai disclosed that he used to sell liquor from the container bearing

Learned counsel for the petitioner submits that nobody has seen the petitioner taking wine from the container parked inside the premises of the police station. Name of the petitioner surfaced in the case on the basis of the disclosure made by Munna Kumar Rai, Chowkidar of Kuchaikote Police Station. Munna Kumar Rai has already been granted bail by order dated 14.11.2019, passed in Cr. Misc. No.66746 of 2019. The case of the petitioner stands on better footing and he is languishing in jail since 24.09.2019.

Considering the facts aforesaid, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge (Excise), Gopalganj in connection with Kuchaikote P.S.
