The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

Allegation is that five unknown miscreants looted away the tractor of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.06.2019. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on self confession made in connection with another case. The petitioner has falsely been implicated in this case. The petitioner had no knowledge that the tractor in question is a looted property. It is further submitted

Patna High Court CR. MISC. No.68411 of 2019(2) dt.25-10-2019 2/2 that the petitioner may be released on bail after completion of nine months in custody from 27.06.2019.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R. and has got criminal antecedents.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completion of nine months from 27.06.2019 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XVth, Patna in connection with Phulwari Sarif (Janipur) P.S. case No.398 of 2019.
