Petitioner apprehends arrest in a case registered for the offence punishable under sections 147/149/341/323/307/353/332/342/504/506 of the Indian Penal Code.

As per the prosecution, 25 FIR named accused persons including this petitioner and 50 unknown persons are alleged to have assaulted the informant with fists and slap and thereafter co-accused Shatrudhan Paswan assaulted by iron rod but anyhow informant could save his life.

It is submitted by the learned counsel for the petitioner that due to scarcity of fertilizer, farmers were facing hardship and due to that reason, some farmers were assembled

Patna High Court CR. MISC. No.74658 of 2022(2) dt.06-04-2023 2/2 at the shop of fertilizer and raised slogan against the informant and on account of which, the informant became annoyed and he has lodged this false case. There is no allegation of any overt act against this petitioner. The petitioner has got clean antecedent. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the CJM East Champaran, Motihari in Turkauliya P.S. case no.845 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
