2. The present application has been preferred for the following relief(s):
for direction to the respondents for demarcation of the piece of the land of petitioner bearing Khata No. 160 (Old), Plot No. 659 (Old) Khata No. 268 (New) Plot No.
755 (New) having its area 1249 sft. Situated at Mauza Katari Thana No. 182 and respondents further be directed take
Patna High Court CWJC No.18263 of 2025(2) dt.20-11-2025 2/3 appropriate legal action against the private respondent No. 9 namely Md. Enam who is disturbing the peaceful possession over the abovesaid land of petitioner forcefully along with antisocial elements in connivance with the officer in-charge of Chandauti police station and to grant any other relief(s) for which petitioner may found entitled in accordance with law.
3. Learned counsel for the petitioner submits that he owns the piece of land bearing Khata No. 160 (Old), Plot No. 659 (Old) Khata No. 268 (New) Plot No. 755 (New) having its area 1249 sft. Situated at Mauza Katari Thana No. 182. The submission is that respondent no. 9, Md. Enam is regularly disturbing and in that background, as a law abiding citizen, he wanted measurement of the land but the Circle Officer, (Town), Gaya (respondent no. 5) is not taking note of the fact which may further result into civil/criminal proceeding.
4. Learned State Counsel submits that if a proper petition along with requisite fee is/are submitted, the matter shall be taken to its logical conclusion.
5. In that background, with the consent of the parties, the writ petition is disposed of directing the Circle Officer, Nagar (Town), Gaya (respondent no. 5) to look into the matter and if within four weeks the petitioner submits his
Patna High Court CWJC No.18263 of 2025(2) dt.20-11-2025 3/3 representation/petition along with the requisite fee, he is dutybound to notice all the concerned parties, fix a date, get the land measured in the presence of the parties asking them to put in their signatures and if any of the party decides not to sign the same, the signatures of local villagers must be taken as witness. The entire process is to be completed latest by 31st March, 2026.
6. The writ petition is disposed of with aforesaid observation.
