The petitioner apprehends his arrest in connection with Suryapura P.S. Case No. 135 of 2019, registered under Section 30(a) of the Bihar Excise Act, 2016.

The accusation is that on receiving secret information about keeping the liquor by Hanuman Singh in his Dalan at village Agrer Kalan, the informant along with other police personnel reached there. On seeing the police party, four persons started to flee away towards the field but on chased, two persons were apprehended while two persons succeeded to flee away. The caught hold persons disclosed their names as Ajay Kahar and Shiv Prasad Singh and they disclosed the names of two persons succeeded to flee away as Krishna Murari Yadav

Patna High Court CR. MISC. No.73094 of 2019(2) dt.19-11-2019 2/2 (petitioner) and Hanuman Singh. On search of Dalan of Hanuman Singh, 11 cartoons each containing 12 bottles of 750 ml and from the pickup van, which was parked in front of his Dalan, 10 cartoons each containing 48 bottles of 180 ml Indian made foreign liquor were recovered.

Learned counsel for the petitioner submits that petitioner was not apprehended at the spot nor he is the owner of Pickup van, from which, 86.4 litres Indian made foreign liquor is said to be recovered. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Sasaram, in connection with Suryapura P.S. Case No. 135 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
