JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 18-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, in the present case, is seeking regular bail in connection with Chanpatia P.S. Case No 258 of 2016, G.R. No. 4855 of 16, registered for offences alleged under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal history. He has been falsely implicated in this case. It is submitted that his name has transpired in the confessional statement of co-accused and the persons similarly situated to the present petitioner have been granted privilege of regular bail by different co-ordinate Benches of this Court.

Patna High Court Cr.Misc. No.3131 of 2018 (2) dt.18-01-2018 2/2 Learned counsel submits that till date no T.I.P. has been conducted even though, the petitioner is in custody since 06.11.2017. Nothing incriminating has been recovered from his possession. Learned APP opposed the prayer for bail.

Considering the facts and circumstances, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, West Champaran, Bettiah in connection with Chanpatia P.S. Case No 258 of 2016 (G.R. No. 4855 of 2016) subject to the conditions U/S 437(3) Cr.P.C.
