The petitioners apprehend their arrest in Nokha P.S. Case No.116 of 2019 registered under Sections 323, 341, 324, 379, 307, 504, 506 and 34 of the Indian Penal Code. The informant alleged that while he was returning after collecting money, both the petitioners intercepted him and snatched Rs.19,000/- from his possession. Binod Choudhary(petitioner No.1) is said to have assaulted with Rami, a sharp edge weapon on his head.

The learned counsel for the petitioners submits that there is a counter version being Nokha P.S. Case No.117 of 2019. In fact, the occurrence took place when the informant

No.68474 of 2019(2) dt.08-11-2019 2/2 parked his motorcycle in front of the darwaza of the informant and when Asha Devi, sister of the petitioners objected, the informant and others assaulted the sister of the petitioners and other family members. It is further submitted that Ranjit Choudhary(the informant) got one simple injury on his head caused by hard and blunt object and not by a sharp edge weapon such as Rami.

Taking into consideration the facts aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. VI, Sasaram, Rohtas in connection with Nokha P.S. Case No.116 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
