Petitioner, already in custody, seeks bail in connection with Nadi P.S. Case No.111 of 2017, giving rise to Special Case No.177 of 2017, registered under Sections 341/323/354(B)/34 of the Indian Penal Code as well as under Sections 4/8 of the POCSO Act.
Allegation in brief is that the accused persons dragged the daughter of the informant to a nearby place and outraged her modesty.
Learned counsel for the petitioner submits that the petitioner is a co-villager and has falsely been implicated, even the said girl has not been examined during investigation and the petitioner has clean antecedent.
Patna High Court Cr.Misc. No.10974 of 2018(3) dt.04-04-2018 2/2 Having considered the said facts and circumstances, petitioner Tutu Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Patna in connection with Nadi P.S. Case No.111 of 2017, giving rise to Special Case No.177 of 2017.
