JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 24-01-2018 Heard learned counsel for the petitioner and the learned counsel representing the State.
The petitioner wants to renew the prayer of bail which was earlier rejected vide order dated 25.05.2017 passed in Cr. Misc. No. 18500 of 2017, on the ground that the petitioner is suffering in custody since 09.09.2015, during investigation major part of allegation made in the FIR has been found not true as against other accused person, final form was submitted. But the petitioner has been charge sheeted. There was cordial relation between the petitioner and his wife. The wife of the petitioner and three years old daughter became traceless and the petitioner is suffering in a false case and as such he deserves sympathetic consideration.
Patna High Court Cr.Misc. No.4498 of 2018 (2) dt.24-01-2018 2/2 The learned A.P.P. opposes the prayer of bail. In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of bail, again prayer of the bail of the petitioner stands rejected in connection with Sessions Trial No. 53 of 2016, arising out of Jamo Bazar P.S. Case No. 66 of 2015 pending in the court of learned 5th Additional Sessions Judge, Siwan.
However, considering the detention of the petitioner, let the trial be expedited and concluded the same, preferably within nine months from the date of receipt/production of copy of this order, failing which, the petitioner may be at liberty to renew his prayer for bail.
